Credit Terms
A line of credit may be established with Byan Systems, Inc, when all terms and conditions herein have been satisfied. A credit application and signed acknowledgment of credit terms, conditions and policies must be submitted with a purchase or accumulation of purchases, equaling $2,000.00 or more, paid C.O.D. certified funds, or in advance.
No credit application will be reviewed without the aforesaid conditions met.
Payment terms for open accounts are as below:
1. After 6 months with bills paid ontime, 5% 10 Net 30.
2. The billing cycle starts the day of shipping.
A credit line of $3,000.00 will be given initially. If this credit line is handled properly, a larger credit line can be arranged.
An interest charge of 1.75% will be assessed on all past due balances.
Any past due account, exceeding 60 days from the shipping date, will constitute cancellation of your credit line agreement.
The debtor, assumes all monetary responsibility, for fees incurred by collection action. This includes collection agencies, attorney fees and court costs.
A restocking charge of 15% will be assessed for all products returned, and are subject to inspection and evaluation by Byan Systems Engineering prior to accepting.
A return authorization number must accompany all products returned or they will not be accepted. Do not return any item without an R.A. number, or it will be refused.
Jurisdiction: This agreement shall be interpreted and governed exclusively by Wyoming Law. The Dealer/Distributor agrees to submit the jurisdiction of the state courts of the state of Wyoming with respect to the litigation of any controversy in connection with this agreement, and the parties each waive all rights to remove the controversy to federal court on grounds of diversity of citizenship. Each party waives any claim to consequential damages.
I have read the above terms, conditions and policies and fully understand my responsibility when establishing an open account with Byan Systems, Inc., and I hereby ratify, approve and agree to the foregoing as conditions of doing business with Byan Systems, Inc.
